This memorandum is intended as a practical, client-facing explanation of how GESY eligibility is assessed in practice, with particular focus on Permanent Residence holders and Israeli clients with cross-border living arrangements.
1. The Core Requirement – Living in Cyprus
GESY is designed for individuals who genuinely live in Cyprus. Holding a Permanent Residence permit is necessary, but not sufficient on its own. The decisive factor is whether Cyprus is your main place of living.
2. The 183-Day Rule (Key Practical Test)
In practice, GESY places substantial weight on physical presence in Cyprus exceeding 183 days per calendar year. This is the clearest and safest way to establish eligibility.
3. The 60-Day Tax Residency Rule – Supportive but Not Determinative
Some individuals qualify as Cyprus tax residents under the 60-day rule. While this demonstrates certain fiscal ties, GESY applies a separate assessment. Tax residency alone does not replace the requirement for substantial physical presence.
4. Salary vs Dividends – How GESY Views Income
The manner in which income is received plays an important role in GESY’s assessment. Salary income is consistently viewed more favourably than dividend income when evaluating genuine residence.
