The European Union Trademark (EUTM) system offers a single registration that extends protection across all EU Member States — a valuable tool for businesses operating or expanding in Europe. However, while the EUTM is efficient and cost-effective, it is not without procedural and practical vulnerabilities. At Lyssiotis Law, we often recommend complementing your EUTM with a Cyprus National Trademark (CYTM) to reinforce your protection strategy and mitigate risk.
Reduced Opposition Risk: An EUTM can face opposition from rights owners in any of the 27 EU jurisdictions. By contrast, a Cyprus Trademark must only pass examination and opposition within a single, familiar jurisdiction — providing a more controlled and predictable process.
Simplified Proof of Use: To preserve an EUTM, genuine use must be proven across multiple Member States. A CYTM, on the other hand, only requires proof of use in Cyprus — a far easier and more practical standard, especially for companies based or operating from the island.
Strategic and Enforcement Value: Cyprus serves as a gateway for international trade, logistics, and corporate structures, often acting as a base for holding and IP-owning entities.
